PLEASE READ THESE TERMS OF SERVICE ("AGREEMENT" OR "TERMS OF SERVICE") CAREFULLY BEFORE USING THE SERVICES OFFERED BY PHOTOFLUX AI. THIS AGREEMENT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE PHOTOFLUX AI WEBSITE AND ALL RELATED SERVICES, INCLUDING, WITHOUT LIMITATION, ANY FEATURES, CONTENT, WEBSITES OR APPLICATIONS OFFERED FROM TIME TO TIME BY PHOTOFLUX AI (COLLECTIVELY "SERVICE(S)").

1. Acceptance of Terms

By using the Services in any manner, you agree to be bound by this Agreement. The Service is offered subject to acceptance without modification of all of these Terms of Service and all other operating rules, policies, and procedures that may be published from time to time by PhotoFlux AI.

2. Rules and Conduct

By using PhotoFlux AI, you agree that:

  • You are at least 18 years old or have reached the legal age of majority in your country of residence
  • You will only use the Service for lawful and ethical purposes

You will not create or distribute content that:

  • Impersonates real individuals without their explicit consent
  • Promotes scams, fraud, or misleading activities
  • Violates privacy or portrays individuals in a harmful light
  • Contains violent, hateful, or discriminatory content
  • Creates false documents or breaches security
  • Exploits or abuses children
  • Generates nudes or pornography

3. Licensing Terms

Subject to your compliance with this Agreement:

  • You are granted a non-exclusive, limited, non-transferable license to use the Service
  • You own all Assets you create with the Services
  • We assign to you all rights to such Assets for your personal or commercial use

4. Fees and Payments

  • Subscriptions automatically renew for the same period
  • You can cancel your subscription at any time through the website
  • No refunds are provided for amounts already paid
  • We reserve the right to change prices and offerings at any time
  • Changes to pricing will not apply until your next renewal

5. Termination

PhotoFlux AI may terminate your access to the Service at any time if you fail to comply with these Terms. You may terminate your account by following instructions on the Service. Any fees paid are non-refundable.

6. Limitation of Liability

IN NO EVENT SHALL PHOTOFLUX AI OR ITS DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS BE LIABLE FOR ANY:

  • Lost profits, data loss, or special, indirect, incidental, punitive, or consequential damages
  • Direct damages in excess of the fees paid by you for the Service or $500, whichever is greater
